5Damage Responsibility & Condition

Inspect the trailer and document its current condition.

Pre-Rental Inspection: Renter acknowledges they have inspected the trailer and accept it in current condition at time of pickup. Any pre-existing damage will be noted by staff.

Damage Policy

RENTER IS FULLY RESPONSIBLE for any damage, theft, or loss of the trailer or its components during the rental period, including wheels, tires, lights, hitches, chains, and tie-downs. Damage costs will be deducted from the security deposit; costs exceeding the deposit are the renter's sole responsibility.

6Prohibited Uses

Review all prohibited use restrictions carefully.

The following uses are STRICTLY PROHIBITED and will result in immediate forfeiture of deposit and termination of rental:

  • NOHauling hazardous materials, chemicals, or biohazards
  • NOOverloading beyond trailer weight/capacity rating
  • NOUse by any driver not listed on this contract
  • NOTowing with an inadequate or improperly rated vehicle
  • NOUse outside the continental United States
  • NOHauling livestock without prior written approval
  • NOAny illegal use or transport of stolen goods
  • NOSubletting or re-renting the trailer to any third party

7Liability Waiver & Terms

LIABILITY WAIVER & RENTAL AGREEMENT TERMS

1. INDEMNIFICATION: Renter agrees to indemnify, defend, and hold harmless Tri County Trailer and Equipment Rental, its owners, employees, and agents from any and all claims, damages, losses, costs, and expenses (including attorney's fees) arising out of or resulting from Renter's use of the trailer.

2. ACCIDENT REPORTING: Renter must immediately report any accident, theft, or damage to Tri County Trailer and Equipment Rental and to local law enforcement. Failure to report may result in additional liability.

3. PROPER HITCH & TOWING: Renter certifies that their towing vehicle is rated to tow the selected trailer and that all hitch connections, safety chains, and lights are properly connected before departing. Tri County Trailer and Equipment Rental is not liable for accidents caused by improper hitching.

4. INSURANCE: Renter's personal auto insurance is primary for any liability, collision, or comprehensive claims arising during the rental period. Tri County Trailer and Equipment Rental carries no liability coverage for renter's use.

5. RETURN CONDITION: Trailer must be returned in the same condition as rented — clean, undamaged (beyond normal wear), with all equipment intact. Renter is responsible for all cleaning and repair costs.

6. GOVERNING LAW: This Agreement is governed by the laws of the State of Texas. Any disputes shall be resolved in Bexar County, Texas.

7. ENTIRE AGREEMENT: This document constitutes the entire agreement between the parties. No verbal representations alter these terms.

8. SEVERABILITY: If any provision is found invalid, remaining provisions remain in full force.
